Faulty Products

ToddCreates provide the following statement in respect of ToddCreates products or services sold by the relevant ToddCreates Partner:

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

For major failures with the service, you are entitled:

• to cancel your service contract with us; and

• to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Returns of faulty products

If the problem with the product is major, you are entitled to:

• a refund of the product from the ToddCreates Partner; or

• a repair or replacement from the ToddCreates. You will need to contact us via your MyDeal account to request a repair or replacement from the ToddCreates Partner.

If a product is faulty and the ToddCreates Partner requires that the product be returned to the ToddCreates Partner you will not need to pay any extra shipping fee for returning the product via standard domestic shipping. If the product is faulty and is not located in Australia, you will be required to pay the relevant international shipping fee for the return of the product.

Examples of major failure are when the product:

• has a problem that would have stopped you buying it had you known about it;

• is unsafe;

• is significantly different from the description of the product; or

• doesn’t do what we said it would do, but does not include damage caused by misuse or returns simply due to change of mind.

If the problem with the product is minor, you are entitled to a full refund of the purchase price of that product from the ToddCreates Partner. If you wish to re-purchase the product, you will need to re-purchase that product (if it is available for purchase) as part of a new order on this marketplace.

You may be refused a refund, repair or replacement if the problem has, for instance, arisen because the product was misused by the customer. The ToddCreates Partner reserves the right to have the product assessed to verify any problem with the product prior to providing you with a suitable remedy.

How to return an ToddCreates item

Returns within 30 days

You can submit a return request for for a faulty product:

(a) Over the phone via ToddCreates customer service

Contact us via your MyDeal account and ask to submit a return request. Our team will then be able to advise you on the next steps

If a product is faulty you will not need to pay any extra shipping fee for returning the product to an ToddCreates Partner.

Returns outside of 30 days

In accordance with the Australian Consumer Law, you are entitled to make a return outside of the 30 day change of mind period if the product is faulty (i.e. has a major or minor problem). You can do this by contacting the ToddCreates team via your MyDeal account to arrange a refund of the product by the ToddCreates Partner and free return of the product to the ToddCreates Partner.

Exchanges

At this stage, ToddCreates Partners do not offer any exchanges forToddCreates products where you have changed your mind about that product.

Refund process

If you are entitled to a refund, ToddCreates will process the refund on behalf of the ToddCreates Partner, however the ToddCreates Partner is responsible for providing you with the refund. All refunds will be made to the original form of payment. After you’ve returned your ToddCreates product to the ToddCreates Partner and your return is processed, it may take a further 3 to 5 business days for the funds to appear in your account. This time may vary depending on your financial institution.

We will only refund the shipping fee (paid by you for ToddCreates products at the time of purchase of those products) if all ToddCreates products purchased by you at that time are faulty. This shipping fee is not refundable if the return if all ToddCreates products purchased by you at the time you placed your order are not faulty.

Additional Information

• ToddCreates products are sold to you by an ToddCreates Partner, who is responsible for providing you with a refund or replacement of a product, or repairing a product, in accordance with the terms of this ToddCreates Returns Policy.

• Where applicable, when you return a product you may be asked to return the product with accessories and instruction manuals.

• You will need to take reasonable precautions so that a product returned to an ToddCreates Partner is not damaged in transit. This includes using suitable packaging to return the product to the ToddCreates Partner.

• Where you return a product to an ToddCreates Partner and that product requires a repair, you should be aware that the repair of that product may result in the loss of any user-generated data stored on the product. Examples of user-generated data include files stored on a computer hard drive, telephone numbers stored on a mobile telephone, songs stored on a portable media player, games saved on a games console and files stored on a USB memory stick. You should also be aware that, in some circumstances, goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

• Some products come with an additional manufacturer’s warranty as indicated in the documentation provided with the relevant products. Should you wish to make any claim under a manufacturer’s warranty, you can do so directly with the relevant manufacturer.
